Chapter 13

Chapter 13 is a wage-earner repayment plan. It is a federal law designed to help individuals, married people and small businesses repay a portion of their debts with dignity and peace of mind. We have the experience to work closely with you to develop a plan for the repayment of debts, present it for creditor approval and have it confirmed by the Bankruptcy Court.

The process of creating the plan, getting it approved by creditors and Chapter 13 Trustee, and confirmed by the Bankruptcy Court takes about three months. Repayment plans typically last three to five years. Upon successful completion of the plan, certain debts are discharged. A Chapter 13 bankruptcy filing may:

  • Allow you to stop the foreclosure on your home.
  • Give you up to five years to catch up on your house payments.
  • Stop the repossession of your vehicle.
  • Allow you to take three to five years to pay off the lesser of the value of your vehicle or the actual amount owing on your vehicle. It may reduce the interest rate you are being charged.
  • Stop the IRS from garnishing your wages. Allow repayment of back taxes with no additional interest or penalties.
  • Allow for the repayment of student loans or child support arrearages.
